TERMS OF SERVICE

By accessing or using the Crew Connect platform, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are accessing the platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. If you do not agree with any part of these Terms, you must not use our platform.

Crew Connect operates an online marketplace that connects clients (including brands, agencies, and influencers) with creative professionals (including photographers, videographers, editors, and production crews) across India. Our services include talent discovery and browsing, job posting and application, portfolio showcasing, booking and project facilitation, and payment processing between clients and talent.

Crew Connect acts as an intermediary platform. We do not directly employ any creative professionals listed on the platform, nor do we guarantee the quality, safety, or legality of services offered by talent or the ability of clients to pay for services.

Registration

To access certain features, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

Account Types

Client accounts are for brands, agencies, influencers, and others seeking creative talent. Talent accounts are for creative professionals offering their services on the platform. Users may not hold both account types simultaneously without prior written approval.

Account Suspension & Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms, engage in fraudulent or harmful behavior, or for any other reason at our sole discretion, with reasonable notice where practicable.

You agree not to use the platform to post false, misleading, or inaccurate information; infringe upon the intellectual property rights of others; harass, abuse, or harm other users; distribute spam, malware, or other harmful content; circumvent platform fees or attempt to transact outside the platform for connections made through Crew Connect; scrape, crawl, or use automated means to access the platform without our written consent; or violate any applicable law or regulation.

Platform Fees

Crew Connect may charge service fees for facilitating transactions between clients and talent. Applicable fees will be clearly disclosed before any transaction is confirmed. We reserve the right to modify our fee structure with reasonable advance notice.

Payment Processing

All payments are processed through our third-party payment partners. By using the platform, you agree to the terms of our payment processors. Crew Connect is not responsible for errors or delays caused by payment processors.

Refunds & Disputes

Refund policies for specific services are determined on a case-by-case basis. In the event of a payment dispute, both parties agree to first attempt resolution through the platform. Crew Connect may mediate disputes but is not obligated to resolve them.

Platform Content

All content on the Crew Connect platform, including the website design, logos, text, graphics, and software, is owned by or licensed to Crew Connect and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable intellectual property laws of India.

User Content

You retain ownership of content you upload to the platform, including portfolio items, profile information, and job postings. By uploading content, you grant Crew Connect a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content solely for the purpose of operating and promoting the platform.

Copyright Complaints

If you believe your intellectual property rights have been infringed on our platform, please contact us at privacy@crewconnect.solutions with details of the alleged infringement. We will investigate and take appropriate action in accordance with applicable law.

To the maximum extent permitted by law, Crew Connect shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform. This includes, but is not limited to, loss of revenue, loss of data, or damages resulting from the conduct of other users.

Our total liability for any claim arising from these Terms or your use of the platform shall not exceed the amount of fees you have paid to Crew Connect in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless Crew Connect, its directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of or related to your use of the platform, your violation of these Terms, your violation of any third-party rights, or any content you submit to the platform.

The platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. Crew Connect does not warrant that the platform will be uninterrupted, error-free, or secure. We do not endorse or guarantee the quality, reliability, or suitability of any talent or client on the platform. Any engagements between clients and talent are solely between those parties.

Your use of the platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data in compliance with the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, and the General Data Protection Regulation (GDPR) where applicable. By using the platform, you consent to the practices described in our Privacy Policy.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Dispute Resolution

Any dispute arising out of or relating to these Terms or the platform shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, the dispute shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Mumbai, India. The language of arbitration shall be English.

Jurisdiction

Subject to the arbitration clause above, the courts of Mumbai, India shall have exclusive jurisdiction over any matters arising from these Terms.

We reserve the right to modify these Terms at any time. Material changes will be communicated through the platform or via email at least 30 days before they take effect. Your continued use of the platform after changes become effective constitutes your acceptance of the revised Terms. If you do not agree with the modified Terms, you must stop using the platform.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
